If you do become incapacitated and do not have a valid Pennsylvania power of attorney (POA), your family member(s), including your spouse, will have to petition the court for a guardianship over your person and estate. This will cause significant delay and could result in economic loss. Additionally, there could be a dispute over who should act if you have not taken the opportunity to name your preferred Agent.

The POA document will allow the individual named to write checks, pay bills, sell real estate, file income tax returns, make investment decisions, make gifts, execute asset protection and Medicaid planning and generally handle your business. Although the document should be highly specialized, the process you undertake with an experienced estate planning attorney in PA will be relatively painless and well worth your while. This is a must have estate planning document and should be incorporated into your plan as soon as possible.
